¨ The com­mitment of the Sel­ler shall be sub­ject to the po­licy of the Go­vern­ment of Pa­kis­tan and For­ce Ma­je­ure;

¨ Firm pri­ces ba­sed on FOB Pa­kis­tan Port and C&F Des­ti­nati­ons shall be sub­ject to the fol­lo­wing con­di­ti­ons:

i) All LC char­ges out­si­de Pa­kis­tan shall be on bu­yers ac­co­unt;

ii) FOB pri­ces shall be sub­ject to chan­ge at the ti­me of ship­ment due to inc­re­ase in the cost of Fur­na­ce Oil, Elect­ri­city, Na­tural Gas, Co­al and Ot­her in­puts;

iii) Due to an inc­re­ase in ex­ci­se du­ty, sa­les tax or ot­her di­rect and in­di­rect ta­xes;

iv) Due to a chan­ge in Go­vern­ment re­gula­ti­ons af­fecting the Ex-Fac­to­ry Cost and/or pri­ce of Ce­ment / Clin­ker or a ge­neral chan­ge in Ce­ment In­dust­ry;

v) Im­pact on the pri­ce and on the ava­ila­bili­ty of the clin­ker be­fore or at the ti­me of ship­ment, due to any of the abo­ve fac­tors or all fac­tors shall be at the risk and cost of the bu­yers.

vi) Any inc­re­ase in the oce­an fre­ight ra­te at the ti­me of ship­ment shall al­so be at the risk and cost of the bu­yers.
